An Urgent Plea to All of My Friends! (Orphan Works Is Evil!)

The following was written by Dena Matthews, fellow medical illustrator:

Dear friends and artists,

I encourage you to support all American artists by voicing opposition to the Orphan Works Acts that are being fast-tracked through Congress. It’s important that you act now – because Congress (both House and Senate) could be voting on this legislation this month.

Here is a brief summary of the problem.

• The Orphan Works Acts, if enacted would change copyright law in such a way that it would be too costly (time and money) to make a living as a visual artist. There would be less of a need for new art because all one’s existing and new work would be open for others to use for free. Today we call those people- who use art without asking- infringers, those who steal art for their own profit.

• The Orphan Works Acts would affect visual artists who do not make a living from their art (create just for the joy of it). Someone, an infringer, would be able to use your art anywhere they like to make a buck and potentially in ways you would object.

• The Orphan Works Acts would also affect anyone who takes snapshot photos and shares them through email or on the web. Your personal family memories could be used by unscrupulous people or in ways you may object - again just to make a buck. The Orphan Works Acts also opens up privacy issues- by allowing others to distribute and sell pictures of your family members and friends.

The Copyright Act of 1976 was created to allow artists to profit from their work thereby encouraging artists to create- a priceless gift that we presently are able to give to the world.

There may be a desire for libraries, museums, etc to acquire truly orphaned works - those in which the author will never be located. Most visual artists would support this cause for the greater good. But these Orphan Works Acts being pushed through congress are written so broadly, they do not take into account the devastating impact they will have on living and available (who can be located) artists.

Please ask your congressmen to vote in opposition to this act- in both house and senate.

"Teresa Stack, The Nation's president, explains the crisis this way: Postal regulators have accepted a scheme designed in part by lobbyists for the Time-Warner media conglomerate. In short, mailing costs for mega-magazines like Time-Warner's own Time, People and Sports Illustrated will go up less than other magazines or even decrease. But smaller publications like The Nation will be hit by an enormous rate increase of half a million dollars a year."

HELP save internet radio!

"As many of you have heard, the US Copyright Royalty Board recently set new royalty rates that all webcasters must pay for the music they play. The rates as adopted are triple the current rates (even more for some webcasters) and will likely mean the long-term extinction of most Internet radio. While the royalty ruling will be appealed over the coming months, the immediate killer is that the new rates go into effect on May 15th and are retroactive to January 2006!

Some webcasters are facing royalty bills that will immediately bankrupt them.

The Copyright Royalty Board quickly and casually dismissed the webcasters' request for a rehearing on April 16th, and at this point, the only thing that is going to stop a large swath of webcasters from going silent on May 15th is Congressional action.

The Ads v. Reality Project

It's so simple, yet so eye-opening if you don't pay attention to advertising and how insidious it is. I personally count marketing & advertising amongst the most deplorable of jobs (in general) out there and find most of it sneaky & conceived to deceive. We don't have any idea how susceptible we are to it all.

This guy (girl?) is taking photos of fast food as it's purchased and posts the "advertised" version next to it for comparison.

Running the Numbers - An American Self-Portrait

Above is an excerpt of an amazing set of work by Chris Jordan. He takes iconic things from everyday American living and makes them into visual statements about our materialism/consumerism. He uses statistics to do it. Be sure you focus on the SIZE of these pieces... most are more than 5 feet long.

Topics include aluminum can use (above) - we use 106,000 aluminum cans every thirty seconds - prison uniforms (to indicate the # of incarcerated individuals), gas caps to stand for how many SUVs were purchased in 2004, etc.

My artistic paradox

Both of these things have happened to me today:

#1 An extremely frustrating interaction with the head-honchos of a freelance project that I've been working on. I am meticulous with the rendering of preliminary sketches for them (from the references I get) and yet, I get 15-20 corrections back on some of my images. A large percentage of which I could not avoid given the instructions I was sent to do the sketch.

This makes me feel like a slovenly, careless, piece-of-crap illustrator.

#2 A comment on Flickr today: "Beautiful.  All your art is quite inspiring.  I have always been one for accuracy in artistic reproductions, especially of animals.  And your art is quite accurate!  I love it."

This from a women who does inspiring, beautiful, and accurate equine illustrations/paintings. This from a fellow artist whom I can respect.

Yet, the head-honchos' opinions held more sway in the moment when I read them. What the HELL?

Here me now: If I do NOTHING ELSE when I'm a MD, I'm going to do this much: I'm going to CHANGE the disconnect between head-honchos and their illustrators. Presently, I feel as if they have no clue about me (my education and training, especially) and I think it's vital that they do. At least, it would help my feelings of self-worth if I knew I had a voice. If/when I'm a head-honcho on a text involving visuals, I will not bow to the "standards" that create this disconnect... I will reach out to my team.

Dear GOD I feel so much ANGER today.

HOW???

My (mostly online) friend Sean died. His apartment building caught fire... last Saturday night. I just can't believe it. How the hell?? He and I had only met once in person to attend an REM show in Indy in 2004, but, if you know the 97X/woxy.com family AT ALL, you know, that we were much closer than most people who only meet once.

He was an incredibly witty, music-snob-par-excellence... a hilarious, caring, and sincere guy. My sister (whose not really on the boards) went with and he treated her like she was a long-lost member of the group - welcomed her with open arms.

I JUST added him to the sidebar on the left - "Kill Your Co-Workers" & just subscribed to his RSS feed, like, Thursday! How can this happen?? And, a FIRE??? Good god.

He was only 34, pretty much my age, and all I can say is that the news has scared the PISS out of me. Primarily in the "you better quit dicking around and worrying about shit and get ON with it already!" concerning my life. He was a fellow Indianan too - a DJ in West Lafayette with ties to Muncie. It's just all similar and familiar... it's just hitting me way harder than I would've expected.

He was a HUGE part of woxy.com and the boards/community over there will NEVER be the same.

Here's what I want you to do, if you've never listened to any of the following bands, they were among Sean's favourites (esp. the top 3)... check a track out on iTunes or allmusic today, won't you? I mean, you never know when you won't have the chance to do things anymore...
